Does a driver have to fully cross the center line and if so, for how long in order for there to be a violation of failure to drive on the right side of the roadway? There is no evidence showing lack of safety for failure to maintain a single lane. | ||

The applicable statute, TTCA 545.051, does not contain any language regarding whether the movement can be done safely, unlike 545.060. Check out Johnson v. State, 365 S.W.3d 484 (Tex. App.--Tyler 2012, no pet.); and Bracken v. State, 282 S.W.3d 94 (Tex. App.--Fort Worth 2009, pet. ref'd). | |||
