The newest provision in the Theft of Service statute allows prosecution if the individual secures performance of the service by agreeing to provide compensation and after the service is rendered failing to pay. There is an attorney is town (civil and criminal defense) that wants to know if clients who don't pay their bill can be prosecuted under this statute. It looks to me like they can but aren't we just becoming bill collectors for the attorney. Does anyone have any ideas about this? I am afraid that our office will be inundated with cases of this type.
