We had an agency bring over some complaints about a company obtaining accident reports several times a week. One of the couriers told an officer they go all over the state and obtain accident reports and then someone contacts victims offering to help.....A few victims have been offended by the solicitation and filed a complaint. The police want us to file under penal code 38.18. In Anderson Courier v State,a civil case, 104 sw3rd 121, the Ct of App in Austin held that the statute unconstitutionally regulated commercial free speech. Has anyone used 38.18 since Anderson? Any thoughts????? | ||
