Facts: The defendant hits a fence and a building and drives away. Damage is over $200. The property is next to a 2 lane street. The cops brought a case as a "leaving the scene" charge. I'm trying to find the correct charge to file it under. I'm looking at Texas Transportation Code 550.025 "operator of a vehicle involved in an accident resulting only in damage to a fixture or landscaping legally on or adjacent to a highway..." I found a definition in 541.302. TRAFFIC AREAS (5) "Highway or street" means the width between the boundary lines of a publicly maintained way any part of which is open to the public for vehicular travel. This is the "highway", aka 601 Ross Street. Google Maps Is it a highway as contemplated by the statute? | ||
