Here are the facts: 17 year old male suspect admits to being in possession of firearm (and is under investigation for theft of it, too). His possession of the firearm occurred while he was an adult (17 yoa). Currently, he is on TYC Parole for Burglary of Building (2 separate counts with separate adjudications). For purposes of PC 46.04 (Unlawful Possession of Firearm) is the 17 year old male a "person who has been convicted of a felony". "Adjudication" under the Texas Family Code (51.13-a) clearly states "...an adjudication or diposition under this title is not a conviction of a crime". I am leaning toward the 17 yoa male NOT satisfying the requirements for PC 46.04 due to this. Any help/guidance is appreciated. Best, CRJ

Not a felon for purposes of that statute. For further discussion go to the juvi forum and look at post from 6/16/05
