The US Supreme Court gave us all one more reason to avoid custodial interrogation. The Court suppressed a confession that was obtained by an officer interrogating a suspect without delivering warnings, getting an oral confession, and then delivering the warnings and obtaining the confession. Too tricky, says the Supremes, and I guess it is no surprise. Now, if the officer had invited in the suspect and made it noncustodial, then the Supremes would never have been involved in the case. That's because noncustodial interrogation doesn't raise the Miranda requirements. So, why aren't you teaching your officers to delay arrests? Most of the time, there is no reason to move to custody.
