Defendant has been charged with harassment MB. Defendant has a girlfriend who has continuously instigated the defendant in harassing the victim via cell phone through text messages and late night phone calls. Victim wants to file charges against the defendant's girlfriend for instigating the defendant in harassing the victim. The girlfriend and defendant have stated that they did not agree to harass victim. What is know is that (1) the defendant got the victim's cell phone number from the girlfriend, (2) the defendant has called and texted the victim repeatedly in reference to an ongoing custody battle between the girlfriend and victim, and (3) the defendant has made statements to the victim threatening him with legal and physical harm because of the ongoing custody battle. I have never had a case like this. Any input from the wise? Thanks. | ||

Check out PC 7.02(a)(2) and see if you think that fits the description of what the girlfriend did. | |||
