We have a case set for trial where we think the defense is going to argue that the defendant committed the offense while sleeping as a means of negating intent. He has given notice of an expert and is evidently going to bring an ear nose and throat doctor and some sleep study. Has anyone seen this defense raised and what issues were raised at your gate keeper hearing. Please feel free to discuss or email me ecarcerano(at)chambers.co.tx.us

Do we have a Texas testifying "expert" on this subject yet?
