Had to get an Attorney Pro Tem appointed to prosecute a MTR on a respondent who happens to be engaged to the County Attorney's secretary. The County attorney shares office space with us. The secretary was the victim of family violence and the Respondent neededo go to the pen and did. I am Art.2.07 CCP. The Judge has kicked the bill back and tells us to pay it. Any suggestions?

Art. 2.07 clearly states that an attorney pro tem who is not a state's attorney "shall receive compensation in the same amount and manner as an attorney appointed to represent an indigent person." Which means that the money comes directly from the indigent defense fund in the county.
