Our county has two dump station locations predominantly used by our county residents that live in unincorporated areas of the county. Until recently the county has not charged fees for people dumping at these locations during the times that burn bans have been ordered by the commissioners' court. Question: Is it legal for the county to charge fees to people that dispose of trash at these county dump stations during periods of a burn ban? I have not found anything that prohibits the collection of fees by the county during the period of a burn ban from people using a county dump station. I have a commissioner who is asking because he has been grilled by some of his constituency telling him it is illegal to collect fees during a burn ban. As you can imagine none of them have provided any statutory authority to back up their position. Any help would be appreciated. | ||
