Maybe I'm missing something...what is the time limit on a person being civilly committed under 46B.106? If a person is found to be insane under 46C, the length can't exceed the max sentence...I'm being told by the facility that this is the standard for 46B.106. Anyone know? | ||

It will be after 9/1, SB 867 adds 46B.0095 Art. 46B.0095. MAXIMUM PERIOD OF COMMITMENT DETERMINED BY MAXIMUM TERM FOR OFFENSE. A defendant may not be committed to a mental hospital or other inpatient or residential facility under this chapter for a cumulative period that exceeds the maximum term provided by law for the offense for which the defendant was to be tried. On expiration of that maximum term, the defendant may be confined for an additional period in a mental hospital or other inpatient or residential facility only pursuant to civil commitment proceedings. | |||
