If a defendant put up a cash bond, was sentenced to probation with a fine, court costs, and probation fees, and was deported immediately without getting his cash bond returned to him, then can the district clerk and the probation department file something to get the fine, court costs, and monthly accumulated probation fees taken out of the cash bond? Judge Becky Simpson of the County Court at Law #1 for Gregg County (Longview) used to have a form for assigning a pro se defendant's cash bond to the payment of the court costs & fees. If memory serves, Judge Simpson allowed willing defendants to sign the forms at the time of the guilty plea. You might contact the misdemeanor prosecutor now assigned to Judge Simpson's court to find out if this practice is still in use. The Gregg County DA's number is 903 236-8440. You might also try to contact the Deputy County Clerk (criminal division) assigned to Judge Simpson's court. The County Clerk's phone number is 903 236-8430. Both should be able to provide more specific information about the form and whether this proceedure is still in use. | |||
