Does anyone have experience dealing with a Respondent parent filing an Affirmative Defense based on the ADA (Americans with Disabilities Act) in a CPS case? In the hypothetical the parent is mentally disabled and claims CPS failed to provide reasonable accommodations for the Respondent Mother in her effort to have her child returned. If so I would appreciate any advice or information you have.
