Q: What, if any, restrictions are there upon a hospital district's authority to sell any of its property/assets? | ||

Shannon, While I don't have much experience with hospital districts, I have learned that the answer might turn on the type of district. Was it created by special legislation, if so , does the enabling statute address the issue? Or, is it a district created under the health and safety code? If so, which section? Typically, those sections are fairly specific about the methods of disposal. For example, A county owned hospital(under H&S 263) may only sell, lease or close a hospital under certian findings by the commissioner's court and then it may be subject to voter approval if a petition is presented. I have not researched whether those same provisions apply to a district but I'm guessing there is similar language. Hope that helps. Mike Hartman Scurry County Atty.
