A JP who has not fulfilled his or her continuing education requirements for the year is subject to removal under Chapter 87 of the Local Government Code. In the meantime, however, does the failure of satisfying educational requirements affect the validity of the JP's actions? Can he still collect money? Can he still set bonds? | ||

The JP is still in office and can set bonds and try cases unless or until suspended during the removal proceedings pursuant to Local Gov't Code 87.017 or other law or action. Being subject to removal and having been removed are two different situations; except for an automatic removal for conviction, some further action is needed to actually remove the judge. This is different from whether or not the JP might be subject to discipline by the Texas State Commission on Judicial Conduct; I'm just addressing the validity of the judge's acts from a legal perspective not a disciplinary possibility.
