59.08 requires that on final judgment, interest earned on seized funds pending disposition is to be distributed in the same manner as the principle. However, is the county entitled to sever the interest earned on the forfeited funds in my forfeiture account? My treasurer showed me an AG opinion that says interest earned on hot check funds goes to the county, but I think forfeiture funds are different. Does anyone have an opinion? Thanks.

Do you still have your copy of the Prosecutor from July-August?

Someone did a chart and a discussion about the monies in forfeiture cases and hot checks. There might be something in there addressing your issue.
