What is the policy in your county for Defense attorneys being able to contact CPS caseworkers directly? | ||

Parents' attorneys can contact caseworkers directly about a case. The caseworkers are good about ending the contact and then calling us if they are unsure of info. they can share or the attorney is too pushy. No written policy. | |||

If you implement a policy, it might be one as simple as "In any SAPCR in which DFPS is a party, contact by any attorney for a respondent or other party with a caseworker or other representative of DFPS in the suit is permissible if the ACA/ADA who is the attorney of record for DFPS consents to such contact." Then, if you do accede to the request, there's no question of violation of DRPC 4.02. Ultimately, it's a judgment call to be based on your relationship with DFPS and the propensities of the particular caseworker at issue. | |||
