We have filed a Motion for Contempt against a protective order respondent for failure to attend BIPP. He lives out of the county, and has since the application for protective order was filed. The show cause order was sent for service to his county of residence. The service was unsuccessful, but the sheriff there thinks the address is good; the respondent is just avoiding us. My first thought was to ask for substitute service and leave the show cause order at the house, but I don't think that helps me much if and when the respondent fails to show up at the show cause hearing. I wouldn't think I could get a capias issued wihtout proof of personal service on the respondent. Any thoughts? | ||
