As expected, an ORR to the Texas Department of Insurance for insurance coverage details on a commercial motor vehicle was met with an exception under 601.454. The statute says: (c) Information obtained under this subchapter is confidential. The agent: (1) may use the information only for a purpose authorized under this subchapter; (2) may not use the information for a commercial purpose; and (3) on request, and subject to appropriate safeguards to protect the privacy of motor vehicle owners developed by the implementing agencies and the attorney general, may provide the information to the attorney general for the purpose of enforcing child support obligations. The question is: Would a subpoena or DWQ be effective for obtaining the requested insurance coverage information? 601 does not address a subpoena for the information, so I don't know if that would be "a purpose authorized under this subchapter." The purpose for the information being sought is civil litigation and not a commercial purpose. Thanks in advance. | ||
