One of my commissioners wants to offer to residents an all-weather road. Basically to lay down caliche. Those who want to participate will pay 40% of the cost and the county will pay 60%. This is for county roads only, no private roads. Most of our roads in that precinct are silty dirt and not passable when it rains. It is only a problem every few years when it actually rains, but it would be a nice improvement. Any reason we can't do this?

As I recall, all the land owners along the road have to agree to pay their portion of the assessment. Don't have it with me or handy at the moment, but it isn't as simple as collecting the money and going forward. Main thing is to be certain that everyone will chip in...otherwise, somebody is getting more for their property taxes than somebody else. Lisa L. Peterson Nolan County Attorney

Section 81.032 of the Texas Local Government Code. E.T. it is a gift the Commissioners Court may accept.
