Here's another chapter 59 question.
I gave my answer 2 years ago, but they're asking again.
I haven't seen any new AG's opinions on the topic and, so far, the law hasn't changed.

PD wants to trade a racing motorcycle (which was forfeited under ch 59) with a dealership for a 4 wheeler.

The PD doesn't have a use for the motorcycle.
The PD would have a use for the 4 wheeler (search and rescue, etc...).

Thoughts?

Doesn't Code say they can auction it off or use it? Aren't they inventing a new disposition by trading? I can imagine abuses that could occur with that approach.

I don't think they can trade it either, but I said that I would ask.

In light of what CNN, chron.com, etc...has reported in Shelby County, I think it would be wise to stay away from anything that's not specifically allowed.
