Disposition of Forfeited Property Login/Join

Can not find this and would like to quickly resolve.

Local PD has forfeited vehicle, '92 Cadillac (or close to that year). Chief wants to know if sale has to be by auction, seal bids or outright?

Or is it up to me as the State's attorney administering the property?

Under CCP Art. 59.06--the property should be dealt with in accordance with "accepted accounting practices" and any local agreement between the parties. Our local agreements require that the law enforcement agency dispose of such property in accordance with the law governing the disposition of surplus property that governs their agency (county, municipal, school, etc...). For a county, that would require the commissioners court to declare the property to be surplus property and for a public auction to be held after notice is given.

If the local agreement does not address this issue, the sheriff conducts a public auction on the 75th day after teh date of final judgment after notice of public auction.
