Has anyone dealt with an incompetent juvenile who was transferred to adult court when he turned 18 under either of these provisions? Among the things I'm curious about are: 1. Should an indictment be obtained after the case is sent to adult court ? 2. Can a 55.44 transfer result in a criminal conviction ? 3. What is the maximum time under CCP 46B.0095 that the former juvenile can be committed pending a return to competence ? Is it controlled by the statutory charged offense or by how long the juvenile could have been sent to TJJD (without a determinate sentence). 55.44(b) speaks of the adult court imposing punishment "for the delinquent conduct". There don't seem to be any cases on either of these two provisions. | ||
