Does anyone out there have a good voir dire for agg robbery where the respondent's claim they used an air soft gun, but the weapon was never recovered? george | ||

I've had a few juvenile cases where air guns were used to rob or to threaten people where the air guns were extremely similar looking to actual pistols. None have gone to trial. I would try to make any attempt at minimization by the defense into a non-issue during voir dire. I might try to get people to think about the difference in the fear a person has when they are robbed by something that looks just like a pistol and something that is a pistol. I doubt that they are thinking, "You'll poke your eye out!" I might ask, in Standefer form, if it matters whether or not a person chose a gun or an air-powered replica. This should be a little easier since juries don't mitigate punishment in standard juvenile cases. Good luck. | |||
