Have juvenile who provided a gun used in an agg robbery. He was also the door man during the robbery but claims that his participation beyond providing the gun (knowing what it was to be used for) was under duress because he was threatened with his life if he didn't go along. I am charging as Agg Robbery F1. Should I include a second count of conspiracy, or make the defense request it (if there is a trial) as a lesser included? Can the jury consider conspiracy if it is not pled in Petition? David Holmes County Attorney - Hill County | ||
