Thankfully, I do precious few of these, but that leaves me in a bit of a quandary today. We had the hearing on our petition for discretionary transfer last week. There were some arguments made by the respondent, and the court took the matter under advisement. The court issued a letter ruling a couple of days later, and then we got an order signed. Assuming that the respondent does not turn himself in after I correspond with his attorney today, do I issue a capias? Every other transfer that I have ever done, the court ruled immediately, and the respondent was present to be taken into custody. | ||
