As much meth business as we have in our area I'm surprised I haven't run into this problem before but here's the scenario: Officers bust in on a working meth lab that has yet to make any finished product. What's the charge? Conspiracy to manufacture? Attempted Manufacture? If so, what amount of controlled substance do you allege? Or is it better to try to go with one of the precurser or lab apparatus offenses e.g., 481.136 or 481.138 which are just state jail felonies.
