Help - Missing Juror - Art. 36.29 Login/Join

At a jury trial, the jury has the case and is deliberating. Recessed for the evening and told to return in a.m. All but one have returned.

I've read 36.29 - don't know yet if diabled applies - Talks about felony trials and being able to continue w/11 if all agree and all sign. What about on Misd. (DWI) trial w/6 (now 5) jurors? Can we proceed?

We are in trial # 2 right now, so don't have alot of time to research and was hoping to tap into the seemingly limitless knowledge of this group. Thanks in advance.

No longer in a hurry. Juror arrived 2.5 hours late - overslept. Now I'm in a hurry to see the Judge sweet talk sleeping beauty. Still curious as to what would have happened.
