Question:
Under 602. et. seq., a law enforcement officer can administer an oath like a notary, it appears. Have you used this in allowing officers to 1) administer oath to other officer making the complaint and /or 2) taking a statement from a witness? Confused

Choices:
we have not allowed it as yet.

We are using that provision on our DWI blood search warrant forms so the officers don't have to find a notary at 3:00 am.
So far, no problems.

We use it in Colorado County for all our witness statements and confessions. A fellow officer can clearly act as a notary for another officer.
