Possession of Prescription Medication Login/Join

I have a Felony Possession of a CS (1st degree) case set for trial where a momma, daddy & son were selling pills out of their house. The family had been getting prescriptions for these pills from several doctors in Houston and Beaumont. So, they do have prescriptions for most (but not all) of the pills. We did not charge them with delivery. Has anyone tried a case like this?

You might think about charging them with HSC 481.129 for obtaining drugs with a fraudulent prescription since they obtained drugs in excessive amounts by not revealing to the prescribing physicians that they already had a full prescription for that drug.
