Now that the SC has granted review of the Texas sodomy statute, today's Austin American Statesman, in the last sentence of the article, reports that the AG is looking to see if he should step into the case:

Hold on. Didn't the last AG take that attitude and get reminded by the Court of Criminal Appeals that the AG may enter a criminal appeal only at the request of the elected district attorney? I guess the campaign really is over.

Is anyone else bothered by this?

Let us hope he is contemplating the issue of seeking leave to file Amicus Curiae.

Harris County DA Chuck Rosenthal has indicated the he will personally argue the sodomy statute case before the US Supreme Court. Glad to see that he is defending our right to litigate our own cases.
