I'm curious as to how other prosecutors offices around the state are handling pit bull attacks. I saw where one office has charged Criminally Negligent Homicide in the case of a dog attack which resulted in death. What other charges might be appropriate where death does not occur; but maybe just bodily injury or SBI?

Rep. Gattis (R-Georgeotown) has filed a bill to up the punishment for an owner failing to secure a dog that causes SBI or death. He filed it because of the problem of trying to file a more general charge of criminally negligent homicide or aggravated assault. To read the bill, click here.

The case that inspired Lillian�s Law is scheduled to go to trial today

Jury selection is set to begin this morning in the criminally negligent homicide case against Thorndale man Jose Hernandez. He was indicted on the charges after his dogs allegedly attacked and killed seventy-eight year old Lillian Stiles in November of 2005. The case has prompted State Representative Dan Gattis Junior to file a bill making the charges filed against Hernandez the standard charges brought against dog owners whose pets kill someone.
