Does anyone consider a digital recorder that was allegedly used to send messages outside of the prison a wireless communications device under 38.11? Definitions do not seem to be on my side.

If it doesn't transmit or recieve I doubt it. If so, a handwritten note would be a wireless communication device.

It is a stretch, but if the recorder had some common components with a cell phone?

Just make sure you handle it with rubber gloves...
