does a defendant have any kind of reasonable expectation of privacy in his employer's records where he used a false SSN on his job and has now filed a motion to suppress the information the employer provided to the police?

The problem is that you are in Texas, which has article 38.23, CCP. It requires suppression of evidence obtained in violation of the law. So, how did the police obtain the records, and was that legal?
