In an appeal from JP/Municipal court to county court, if the judge mentions in the presence of the jury that the case is an appeal, is that error curable by instruction? | ||

I would think so. Especially if the judge explains the "trial de novo" concept in the instruction. I realize that the cat would be out of the bag, but I don't see incurable harm | |||
