No wonder our court systems are clogged. The 8th Circuit recently had to take time to consider whether a prisoner's rights under the 14th Amendment were violated because the staff told him and his group of inmates to "shut up" even though they said nothing to an equally noisy group of inmates of another race (i.e., unequal chastisement). May 11, 2007 Lewis v. Jacks, No. 06-1995

Answer: Claim dismissed

"Lewis alleged that Jacks made him sew all the right pockets on pants being assembled by the factory, while four inmates were allowed to sew on the left pockets. But he acknowledged that one of the four was black, and he offered no other evidence that Jacks or any other garment factory supervisor assigned work on the basis of the inmates' race."
