Had an incriminating text pop up on a defendant's iPhone during an arrest in a drug case. Those of yall familiar with the iPhone know the content of the text message pops up on the screen even if the phone is locked, so plain view helped get it in over a suppression. Thank you, Cupertino!

What are you advising your officers about whether or they can scroll a cell phone without a warrant, whether or not it is done at the scene and whether or not they then return it to the defendant afterwards.
