The facts: County wants to give some real property to a water supply corporation (Ch. 67, Water Code). The WSC appears not to be considered a governmental entity or political subdivision so as to avoid the required bidding or auction procedures set out in LGC 272.001(b)(5) or 263.001. See Tex. Att'y Gen Op. No. GA-0111; Tex. Att'y Gen. LO-95-011(1995); Tex. Att'y Gen. OR2005-06883. Is there a provision that I am missing that allows for the county to give (or perhaps sell) the property to the WSC for less than fair market value, while avoiding the bidding or auction procedures? | ||
