I learned yesterday that HB1421, which takes effect September 1, 2013, amends CCP 18.19 to authorize seized weapons to be SOLD at auction (if they are not destroyed, forfeited to the state for use, or returned to the person from whom they were seized) by the law enforcement agency holding the weapon(or by a licensed auctioneer). If sold at auction, only a licensed federal firearms dealer may purchase the weapon, and proceeds from the sale, after deduction for court costs(clerk’s fees if any) and auction costs, go to law enforcement. I thought this was worth passing on for those who may not have already noticed it.
