Form CIS prepared by the Texas Ethics Commission has a line for Did Not Accept Gift. My review of the statute does not locate the rejected gift line. My research on the word "given" as used in Section 176.003(a)(2)(B) indicates that common meaning is presented or bestowed.

So, is the thinking that if "A Big Vendor" presents a BMW to the Commissioner who rejects the "gift" then and there, the Commissioner must report the rejection under Section 176.004? If that is the case the corresponding language in Section 176.004(1)(B)fails to support such a disclosure. I find the reporting requirement to be "gifts accepted" in 176.004(1)(B). My bet is that a court divining legislative intent would have a hard time turning "accepted" into "offered."

So please clear up my confusion about this tiny portion of this model ethics disclosure act? Wink
