Casino floor is not a weapon

quote:
the prosecutor argued that an arm lock and taking the man to the floor met the law's requirement of using objects likely to produce bodily harm.

But the unanimous high court ruling says that definition doesn't include a bare arm or a floor - unless a victim is repeatedly slammed against it - and that didn't happen in this case.

---

The case is State of Washington v. James Michael Marohl, docket number 83570-5.

(note: the victim's arm that was broken was prosthetic...)

Prosecutors alleged that Cole Allen Wilkins stole several major appliances from a Riverside construction site, put them untied in the back of his truck, and fled down a freeway. When a stove fell onto the highway, a Los Angeles County Sheriff's deputy on his way to work swerved to avoid it and was fatally crushed by a cement truck. Wilkins was convicted of first-degree murder and sentenced to 26 years to life.

The story is here.

A Central California man who was at a cockfight died after being stabbed in the leg by a bird that had a knife attached to its own limb, officials confirmed Monday.

Jose Luis Ochoa, 35, of Lamont, was declared dead at a hospital about two hours after he was injured in neighboring Tulare County on Jan. 30, the Kern County coroner said.

An autopsy concluded Ochoa died of an accidental "sharp force injury" to his right calf.

Man holds coworkers at knifepoint to watch American Idol

TV news station WJXT reports that Brooklyn, New York man Barran Prakash, 47, wanted his co-workers to change the TV channel so he could watch "American Idol."

Like all friendly arguments that happen over the popular singing talent show, things turned very violent when Prakash grabbed a large butcher knife and held it to one man's throat, according to the report.

(My favorite part of the report: "It's also good to note that the show was not even scheduled to air that night.")

Oregon court rules teeth not a deadly weapon

"Biting your opponent during a brawl may violate the rules of what's considered a fair fight, but it doesn't turn the attack into first-degree assault.

The Oregon Court of Appeals has ruled Wednesday that teeth cannot be considered dangerous weapon in a case that grew out of a 2008 fight between two Marion County men."

A glaring question plaguing this banjo player is whether the alledged teeth were naturally growing within the mouth of the attacker, or if they were held in his hand and thrust or plunged into the flesh of the victim before being returned to the jar on the nightstand.

Dead Weasel

HOQUIAM, Wash. (AP) - Police say a man was carrying a dead weasel when he burst into an apartment and assaulted a man in Washington state.
The victim asked, "Why are you carrying a weasel?" Police said the attacker answered, "It's not a weasel, it's a marten," then punched him in the nose and fled.

The attacker was apparently looking for his girlfriend and had gone to her former boyfriend's apartment Monday where the victim was a guest.
