Inmate learns DNA can also be used to affirm convictions DNA tests have proved that Lee Wheeler committed a 1984 rape for which he's already serving life in prison. At a hearing this morning, state District Judge Larry Mitchell (the same judge who freed a wrongly convicted man last week) re-affirmed Mr. Wheeler's guilt based on the tests. ----- Wait. You mean everyone who requests DNA testing... isn't innocent. Wow. | ||

As JB has often said, if the defendant's pleadings or affidavits contained any false information used to obtain the testing, he should be prosecuted for those lies as well. | |||

Tampering with government record by filing a false statement in a pleading. Or aggravated perjury if sworn statement. Stacked sentence because defendant committed the crime while serving a prison sentence, see article 42.08, CCP. | |||
