Inmate learns DNA can also be used to affirm convictions

DNA tests have proved that Lee Wheeler committed a 1984 rape for which he's already serving life in prison.

At a hearing this morning, state District Judge Larry Mitchell (the same judge who freed a wrongly convicted man last week) re-affirmed Mr. Wheeler's guilt based on the tests.

Wait. You mean everyone who requests DNA testing... isn't innocent. Wow.

As JB has often said, if the defendant's pleadings or affidavits contained any false information used to obtain the testing, he should be prosecuted for those lies as well.

Tampering with government record by filing a false statement in a pleading. Or aggravated perjury if sworn statement. Stacked sentence because defendant committed the crime while serving a prison sentence, see article 42.08, CCP.
